Terms of Service

Introduction

Bazaar provides tools to manage gear, list items for sale, and connect with other users. These Terms apply to all users and visitors.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use Bazaar. If you use Bazaar on behalf of an organization, you represent you have authority to bind that organization.

Accounts & Security

• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• Provide accurate information and keep it up to date (e.g., email, display name, location settings).
• Notify us immediately of any unauthorized use or security incident.

Marketplace & Gear

• You may list items that you have the right to sell. Provide accurate titles, descriptions, prices, and condition.
• Items marked sold may be scheduled for deletion after a period (non-gear listings may be removed after sale).
• Location data may be coarse or precise depending on your settings; do not share private address information in listings or messages.
• Maintenance history and gear data you attach to listings should be truthful and non-misleading.

Subscriptions & Billing

• Paid plans are billed via Stripe. Plan limits (e.g., gear/listing caps) apply as shown in the app.
• Downgrades may reduce your limits; you remain responsible for fees incurred before downgrade or cancellation.
• Taxes may apply. You authorize us and Stripe to charge your selected payment method.

User Content

• You retain ownership of content you submit (listings, images, messages, maintenance records). You grant Bazaar a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content to operate the service.
• Do not upload content you do not have rights to, or that violates law or these Terms.
• Public listings and media may be viewable by others. Avoid including sensitive personal data.

Acceptable Use

• No illegal, fraudulent, infringing, or deceptive activity.
• No harassment, threats, hate speech, or abuse in listings or messages.
• No scraping, rate abuse, or attempts to bypass security or access controls.
• No malware, phishing, or attempts to harvest other users’ personal data.
• Respect rate limits and platform rules for listings, images, and messages.

Payments & Fees

• Payments and subscriptions are processed by Stripe; Stripe’s terms and privacy policy apply.
• We do not store full card details; Stripe provides us tokens/IDs to manage billing.
• Refunds, chargebacks, and disputes are handled per Stripe policies and applicable law.

Privacy

Your use of Bazaar is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

Suspension & Termination

• We may suspend or terminate access for violations of these Terms, legal requirements, or risk to the platform or users.
• You may stop using Bazaar at any time; subscription cancellation is managed via Stripe’s billing portal.
• We may remove or disable content that violates these Terms or law.

Disclaimers

Bazaar is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation.

Limitation of Liability

To the maximum extent permitted by law, Bazaar and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our aggregate liability relating to the service will not exceed the greater of (a) amounts you paid to us in the 3 months before the claim or (b) $50.

Indemnity

You agree to defend, indemnify, and hold harmless Bazaar from claims arising out of your content, your use of the service, or your violation of these Terms or applicable law.

Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, unless prohibited by applicable law.

Changes to these Terms

We may update these Terms. We will update the “Last updated” date and may provide in-app notice for material changes. Continued use after changes takes effect means you accept the updated Terms.
